It was appointed on 7 November 2012, following the 2012 general election held two weeks earlier.<ref name=nov2012-2>{{cite web|title= Australian Capital Territory (Self-Government) Ministerial Appointment 2012 (No 2)|url=https://www.legislation.act.gov.au/View/ni/2012-580/20121109-54199/PDF/2012-580.PDF}}</ref>

The previous First Gallagher Ministry contained only members of the ACT Labor Party. In the 2012 general election, neither of the territory's two major parties (Labor and Liberals) had won sufficient number of seats to form government in their own right and would need the support of the sole Greens representative Shane Rattenbury. Rattenburry came to a formal parliamentary agreement with the Labor Party in order to form a coalition government, which meant that he would be appointed to the cabinet, and implement nearly 100 policies and reforms.<ref>{{cite web|url=http://www.cmd.act.gov.au/__data/assets/pdf_file/0004/383476/parliamentaryagreement.pdf|title=Parliamentary Agreement for the 8th Legislative Assembly for the Australian Capital Territory|website=Chief Minister, Treasury and Economic Development Directorate|accessdate=6 November 2019|archiveurl=https://web.archive.org/web/20130410160106/http://www.cmd.act.gov.au/__data/assets/pdf_file/0004/383476/parliamentaryagreement.pdf|archivedate=10 April 2013|url-status=live}}</ref>

==First arrangement== Following the 2012 general election, the Greens-Labor agreement allowed Labor to retain government and guaranteed Shane Rattenbury's position in the Ministry. Gallagher appointed herself, her deputy Andrew Barr, Rattenbury and two other incumbent ministers into the Ministry without portfolio on 7 November 2012.<ref>{{cite web|title= Australian Capital Territory (Self-Government) Ministerial Appointment 2012 (No 1)|url=https://www.legislation.act.gov.au/View/ni/2012-573/20121107-54192/PDF/2012-573.PDF}}</ref> Incumbent minister Chris Bourke was not reappointed to the Ministry.

Portfolios were allocated two days later on 9 November 2012.<ref name=nov2012-2/> The arrangement lasted until 6 July 2014. {| class="wikitable" |- ! Portfolio !
