He was born in [Glen Innes](/source/Glen_Innes%2C_New_South_Wales) to Patrick Kinsella and Mary Jane, ''née'' Sharman. He attended St Patrick's College in [Goulburn](/source/Goulburn%2C_New_South_Wales) and was employed as a cadet draftsman with the Lands Department in [Wagga Wagga](/source/Wagga_Wagga), [Moree](/source/Moree%2C_New_South_Wales) and [Sydney](/source/Sydney) from 1910 to 1914. During [World War I](/source/World_War_I) he served in the [2nd](/source/2nd_Battalion_(Australia)), [54th](/source/54th_Battalion_(Australia)) and [56th](/source/56th_Battalion_(Australia)) Battalions, seeing action at [Gallipoli](/source/Gallipoli) and [Flanders](/source/Flanders) and rising to the rank of [lieutenant](/source/lieutenant). On 2 August 1919 he married Marie Louise Graff, with whom he had five children. After the war Kinsella returned to the Lands Department and studied law part-time at the [University of Sydney](/source/University_of_Sydney), graduating with his [Bachelor of Law](/source/Bachelor_of_Law) in 1927, in which year he was called to the Bar. In 1930 he was elected to the [New South Wales Legislative Assembly](/source/New_South_Wales_Legislative_Assembly) as the [Labor](/source/Australian_Labor_Party_(New_South_Wales_Branch)) member for [Georges River](/source/Electoral_district_of_Georges_River), but he was defeated in 1932. He was appointed a [District Court](/source/District_Court_of_New_South_Wales) judge in 1943 and in that year was also appointed to the [Industrial Commission of NSW](/source/Industrial_Relations_Commission_of_New_South_Wales). He served as a judge of the [Supreme Court of New South Wales](/source/Supreme_Court_of_New_South_Wales) from 1950 to 1963. Kinsella was appointed a [Commander of the Order of the British Empire](/source/Commander_of_the_Order_of_the_British_Empire) in 1964.
