Davis was born in [Portsmouth, Virginia](/source/Portsmouth%2C_Virginia). He attended [Longwood College](/source/Longwood_University) in [Farmville](/source/Farmville%2C_Virginia), transferring to and receiving a [Bachelor of Arts](/source/Bachelor_of_Arts) degree from the [University of Virginia](/source/University_of_Virginia) in 1984, and a [Juris Doctor](/source/Juris_Doctor) from [Washington and Lee University School of Law](/source/Washington_and_Lee_University_School_of_Law) in 1988.<ref name="virginiabusiness"/> He was a [law clerk](/source/law_clerk) for Judge [John Ashton MacKenzie](/source/John_Ashton_MacKenzie) of the United States District Court for the Eastern District of Virginia from 1988 to 1989. S. Ellis III](/source/T._S._Ellis_III).
