==Early life and education==
Mthiyane was born in Ndwedwe, in [Kwazulu-Natal](/source/Kwazulu-Natal) and received his education at Loram Secondary school, where he matriculated in 1967. He then enrolled at the [University of South Africa](/source/University_of_South_Africa) and obtained his BIuris degree in 1972 after which he furthered his studies at the [University of Natal](/source/University_of_Natal) obtaining an [LL.B.](/source/LL.B.) in 1984 and an [LL.M.](/source/LL.M.) in 1994.<ref name=":1">{{Cite journal|date=1997|title= The Judiciary|url=https://www.gcbsa.co.za/law-journals/1997/may/1997-may-vol010-no1-pp21-22.pdf|journal= Consultus|volume=10|issue=1|pages=22|via= General Council of the Bar of South Africa}}</ref>

==Career==
Mthiyane was admitted as an [attorney](/source/Attorney_at_law) in 1975 and nine years later was admitted as an [advocate](/source/advocate), joining the Durban [Bar](/source/Bar_(law)) in 1984. He was granted [senior counsel](/source/senior_counsel) status in 1995 and was given his first acting judge appointment shortly thereafter. Mthiyane was appointed judge to the [KwaZulu-Natal Division](/source/KwaZulu-Natal_Division) of the High Court.<ref name=":1" /> In 2001, he was appointed a Judge of the [Supreme Court of Appeal](/source/Supreme_Court_of_Appeal_of_South_Africa) and, after serving for eleven years in that court, was appointed its Deputy President of the court in 2012, which post he held until he retired in 2014.<ref>{{Cite web|title=Supreme Court of Appeal: History|url=https://www.supremecourtofappeal.org.za/index.php/history|access-date=2021-03-01|website=www.supremecourtofappeal.org.za}}</ref> He then served as a Chairperson of the [Electoral Court of South Africa](/source/Electoral_Court_of_South_Africa).<ref name=":0" />
