==Early life and career==
Malins was born in [Nuneaton](/source/Nuneaton), [Warwickshire](/source/Warwickshire) and educated at [St John's School, Leatherhead](/source/St_John's_School%2C_Leatherhead) and [Brasenose College, Oxford](/source/Brasenose_College%2C_Oxford); he gained an [MA](/source/Master_of_Arts_(Oxford%2C_Cambridge%2C_and_Dublin)) in Jurisprudence in 1967. He qualified as a solicitor in 1971 and worked in a major Surrey law firm from 1975 to 1988. From 1973 to 1983, Malins was a member of [Mole Valley District Council](/source/Mole_Valley).
He contested [Liverpool Toxteth](/source/Liverpool_Toxteth_(UK_Parliament_constituency)) in both 1974 general elections and [Lewisham East](/source/Lewisham_East_(UK_Parliament_constituency)) in the [1979 general election](/source/1979_United_Kingdom_general_election).
==Parliamentary career==
In the [1983 general election](/source/1983_United_Kingdom_general_election), Malins was elected MP for [Croydon North West](/source/Croydon_North_West_(UK_Parliament_constituency)), defeating [Bill Pitt](/source/Bill_Pitt_(politician)) who had been the constituency's MP since the [1981 by-election](/source/1981_Croydon_North_West_by-election). Malins spent most of his first period as an MP on the backbenches, but was [Parliamentary Private Secretary](/source/Parliamentary_Private_Secretary) to [Tim Renton](/source/Tim_Renton) from 1987 to 1989 and then [Virginia Bottomley](/source/Virginia_Bottomley) from 1989 to 1992.
In the [1992 general election](/source/1992_United_Kingdom_general_election), he was defeated for re-election by the [Labour](/source/Labour_Party_(UK)) candidate [Malcolm Wicks](/source/Malcolm_Wicks). In 1993, he founded the [Immigration Advisory Service](/source/Immigration_Advisory_Service), a charitable organisation providing free legal advice on immigration and asylum issues. He became a District Judge in 1991 and in 1996 became a Recorder at the [Crown Court](/source/Crown_Court). In 1997 he was made a commander of the [Order of the British Empire](/source/Order_of_the_British_Empire) for services to immigration policy.
At the [1997 general election](/source/1997_United_Kingdom_general_election), he was selected for the safe Conservative seat of [Woking](/source/Woking_(UK_Parliament_constituency)). On his return to Parliament, he became a member of the [Home Affairs Select Committee](/source/Home_Affairs_Select_Committee).
Malins supported [Kenneth Clarke](/source/Kenneth_Clarke)'s failed bid in the [2001 leadership contest](/source/2001_Conservative_Party_leadership_election), but nonetheless was appointed to [Iain Duncan Smith](/source/Iain_Duncan_Smith)'s [front bench](/source/front_bench) team as a junior home affairs spokesman.
In March 2003, he resigned from the opposition front bench in protest at their support of the [Invasion of Iraq](/source/2003_invasion_of_Iraq). He was later re-appointed to the front bench as a shadow home affairs minister when [Michael Howard](/source/Michael_Howard) became leader in November 2003, but returned to the backbenches under [David Cameron](/source/David_Cameron).
