At the outbreak of the [American Civil War](/source/American_Civil_War) in 1861, Gates enlisted in the [Confederate Army](/source/Confederate_States_Army), starting as a [captain](/source/Captain_(United_States)) in the [Missouri State Guard](/source/Missouri_State_Guard) under the command of General [Sterling Price](/source/Sterling_Price), and was later promoted to [colonel](/source/Colonel_(United_States)) of the [1st Missouri Cavalry Regiment](/source/1st_Missouri_Cavalry_Regiment_(Confederate)). He commanded his regiment at the [Battle of Pea Ridge](/source/Battle_of_Pea_Ridge), Arkansas in March 1862, during the [Siege of Corinth](/source/Siege_of_Corinth), Mississippi, and at the Battles of [Iuka](/source/Battle_of_Iuka), [Second Corinth](/source/Second_Battle_of_Corinth), [Champion Hill](/source/Battle_of_Champion_Hill), [Big Black River Bridge](/source/Battle_of_Big_Black_River_Bridge) and at the [Siege of Vicksburg](/source/Siege_of_Vicksburg), Mississippi. He also temporarily commanded the [1st Missouri Brigade](/source/First_Missouri_Brigade). In 1864, Gates participated in the [Atlanta campaign](/source/Atlanta_campaign) and the [Battle of Allatoona](/source/Battle_of_Allatoona), Georgia, and lost an arm at the [Battle of Franklin](/source/Battle_of_Franklin_(1864)), Tennessee. During his service, he was wounded five times, captured by [Union forces](/source/Union_Army) three times, and had four horses shot from underneath him. On April 9, 1865, the same day Confederate General [Robert E. Lee](/source/Robert_E._Lee) surrendered to Union General [Ulysses S. Grant](/source/Ulysses_S._Grant), Colonel Gates was engaged in one of the last battles of the Civil War, the [Battle of Fort Blakeley](/source/Battle_of_Fort_Blakeley) in Alabama.<ref name="missouristatetreasurer" />

Following the war, Gates returned to his farm. In 1874, he was elected as [Sheriff](/source/Sheriffs_in_the_United_States) of Buchanan County, serving in that post until 1877.
