The **Delaware Court of Common Pleas** are [state courts](/source/State_court_(United_States)) of the [U.S. state](/source/U.S._state) of [Delaware](/source/Delaware).

The Delaware Court of Common Pleas are [trial courts](/source/Trial_court) and inferior courts of [limited jurisdiction](/source/Limited_jurisdiction).[1] It has [criminal](/source/Criminal_law) [jurisdiction](/source/Jurisdiction) throughout the state over all [misdemeanors](/source/Misdemeanor), except certain drug offenses, and [motor vehicle](/source/Motor_vehicle) offenses (see [traffic court](/source/Traffic_court)). The Court of Common Pleas also holds [preliminary hearings](/source/Preliminary_hearing) in [felony](/source/Felony) cases,

In [civil](/source/Civil_law_(common_law)) matters, Court of Common Pleas tries [lawsuits](/source/Lawsuit) in which the [amount in controversy](/source/Amount_in_controversy) does not exceed $50,000 ([small claims](/source/Small_claims_court)), petitions for [name change](/source/Name_change), habitual offender hearings on the privilege of operating a motor vehicle, and [administrative appeals](/source/Administrative_law) from the [Division of Motor Vehicles](/source/Department_of_Motor_Vehicles). The Court of Common Plea also has [appellate jurisdiction](/source/Appellate_jurisdiction) of criminal matters from Alderman's Courts and criminal and civil matters from the Justice of the Peace Courts.

The [Superior Court of Delaware](/source/Delaware_Superior_Court) is the court of [general jurisdiction](/source/General_jurisdiction) in Delaware. It has [original jurisdiction](/source/Original_jurisdiction) in all felony cases and civil suits in which the amount in controversy exceeds $75,000. Appeals from the Court of Common Pleas generally go to the Superior Court.

The Court currently consists of nine judges sitting in [Delaware's three counties](/source/List_of_counties_in_Delaware): Five in [New Castle County](/source/New_Castle_County%2C_Delaware), two in [Kent County](/source/Kent_County%2C_Delaware), and two in [Sussex County](/source/Sussex_County%2C_Delaware). The Court has three problem-solving court divisions: A [Drug Diversion Program](/source/Drug_court), a Community Dispute Resolution Program, and a [Mental Health Court](/source/Mental_health_court).
